Content migration

We are pleased to migrate in content from your existing website. We’ll do our best to bring everything across but compromises may be made – particularly on layout and formatting.

Up to 10 standard pages are included. If you have more than this and/or your pages are more complex then we will contact you to discuss options. This service is subject to availability and requires payment by 20th May.

We believe that it is in both of our interests to set expectations up front. By purchasing this service you are agreeing to these terms.

You. You, being the authorised representative of a swim club, are referred to as the ‘Client’ in these terms and conditions.

Us. These services are provided by Mensard Pty Ltd trading as Swim.Rocks, PO Box 212, St Ives, NSW 2075, Australia. ABN 12 140 276 866. The proprietor is Ben Ramsden email: hello@swim.rocks phone: 0406 401 180. Any issues should be addressed to him.

Services. Mensard will supply to the Client a hosted website template including technical support via email, plus any other services mutually agreed in writing.

Pricing. Pricing is shown in the pricing list and may be adjusted from time to time.

Payment terms. Payment in full is required before Mensard starts work. Payments are based on build start dates, not delivery. Services will be withdrawn in the event of payment being outstanding for over 30 days.

Refunds. Clients benefit from a 100% full refund guarantee for 30 days from purchase or annual renewal. This does not apply to ‘optional extras’ labelled us such in the pricing list and order form.

Renewal. This agreement will be automatically be renewed 1 year after purchase at the prevailing price unless cancelled prior.

Termination. This agreement may be terminated at any time by either party by giving 30 days notice in writing. Any work paid for but not delivered may be refunded at the discretion of Mensard.

Freedom to leave. The client may request a full backup copy of their website data so that they can migrate elsewhere. The Mensard charge for providing a backup copy is shown in the price list.

Ownership. All work delivered and paid for is owned by the Client. All other work remains owned by Mensard.

Design. Mensard may at its discretion use different components from those specified to deliver the agreed Client requirements. In such cases the pricing will remain unchanged.

Variations. Any variations must be agreed in writing.

Disclaimer of Warranty. The service includes open source software components. As a result is no warranty for the service being fit for purpose.

Limitation of liability. The limit of any liability of Mensard to the Client for any and all claims, losses, costs, damages of any nature whatsoever or claims expenses from any cause or causes, shall not exceed the total fee for services rendered on the project.

Updates. These terms and conditions may be updated from time to time.

Jurisdiction. This agreement is subject to the laws of NSW, Australia.
